1. OUR SERVICES

Description. Pet Union is a South African pet social and multi‑vendor marketplace that enables users to create pet profiles, buy and sell pet products, book pet care services, and arrange delivery via couriers or locker pickup. Vendors may list products and services, manage inventory, and fulfil orders through the marketplace.

Eligibility. You must be 18 years or older to register. By creating an account you represent that you are legally capable of entering into binding contracts and that the information you provide is accurate and complete.

Accounts and access. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use.

2. INTELLECTUAL PROPERTY RIGHTS

Site content. All content on the Site, including text, graphics, logos, images, software and code, is owned by Pet Union or its licensors and is protected by copyright, trademark and other intellectual property laws.

Limited licence. Subject to these Terms, Pet Union grants you a limited, non‑exclusive, non‑transferable licence to access and use the Site for personal or business purposes in connection with buying or selling on the marketplace.

Restrictions. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit Site content except as expressly permitted by Pet Union or by law.

3. USER REPRESENTATIONS

Accuracy and compliance. You represent and warrant that: (a) any information you provide is accurate and complete; (b) you will comply with these Terms and all applicable laws and regulations; and (c) you have the right to provide any content you submit.

Vendor representations. Vendors represent that they are authorised to sell the products and services they list, that listings are accurate and lawful, and that they will fulfil orders in accordance with the descriptions and delivery promises made on the Site.

4. PROHIBITED ACTIVITIES

You agree not to engage in any activity that:

• Violates applicable law or these Terms.
• Infringes intellectual property or privacy rights of others.
• Is fraudulent, deceptive, or harmful (including misrepresenting product origin, condition, or availability).
• Interferes with the operation of the Site, attempts to access restricted areas, or reverse engineers our systems.
• Uses the Site to transmit malware, spam, or unsolicited communications.

Violation of these rules may result in account suspension, removal of content, or legal action.

5. USER GENERATED CONTRIBUTIONS

Definition. User Generated Contributions include reviews, ratings, comments, photos, product descriptions, messages and other content you submit to the Site.

Responsibility. You are solely responsible for your contributions. You must not post content that is unlawful, defamatory, obscene, infringing, or otherwise objectionable.

Moderation. Pet Union may review, remove, or refuse to post contributions that violate these Terms or our policies. We do not guarantee prior review and are not responsible for user content.

6. CONTRIBUTION LICENSE

License to Pet Union. By submitting contributions you grant Pet Union a worldwide, non‑exclusive, royalty‑free, transferable, sublicensable licence to use, reproduce, modify, publish, translate, distribute and display the contributions in connection with operating and promoting the Site.

Moral rights. Where permitted by law you waive moral rights in your contributions to the extent necessary for Pet Union to use them as described.

7. SERVICES MANAGEMENT

Operational control. Pet Union may manage, restrict, suspend or discontinue features of the Site for maintenance, security, or business reasons. We will endeavour to provide notice for planned interruptions where practicable.

Vendor fulfilment. Vendors are responsible for order fulfilment, product quality, compliance with applicable laws, and customer service for their listings. Pet Union facilitates marketplace operations but is not the seller of vendor products unless explicitly stated.

8. TERM AND TERMINATION

Term. These Terms remain in effect while you use the Site.

Termination by you. You may close your account at any time via account settings or by contacting support.

Termination by Pet Union. We may suspend or terminate your access for breach of these Terms, fraudulent activity, or other legitimate business reasons. Upon termination, your rights to use the Site cease and we may remove your content.

Survival. Provisions that by their nature should survive termination (e.g., indemnification, limitations of liability, intellectual property, dispute resolution) will survive.

9. MODIFICATIONS AND INTERRUPTIONS

Changes to Terms. We may modify these Terms from time to time. Material changes will be posted with an updated effective date and, where required by law, we will seek consent. Continued use after changes constitutes acceptance.

Service interruptions. We do not guarantee uninterrupted access. We are not liable for temporary outages, maintenance downtime, or interruptions caused by third parties.

10. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles, except where mandatory consumer protections require otherwise.

11. DISPUTE RESOLUTION

Informal resolution. Before initiating formal proceedings, please contact support to attempt to resolve disputes informally.

Arbitration and small claims. Where permitted by law, disputes may be resolved through arbitration or small claims procedures rather than court litigation. Specific dispute resolution procedures, including any arbitration agreement, will be set out where required by law or in separate agreements.

Injunctive relief. Nothing in these Terms prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

12. CORRECTIONS

We strive for accuracy but the Site may contain errors or inaccuracies. We reserve the right to correct errors, update information, and change or remove content without prior notice.

13. DISCLAIMER

No warranties. The Site and services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non‑infringement.

Third‑party services. We may integrate with third‑party services (payment processors, couriers, analytics). We do not warrant the performance of third parties and are not responsible for their acts or omissions.

14. LIMITATIONS OF LIABILITY

Exclusion of certain damages. To the maximum extent permitted by law, Pet Union and its affiliates will not be liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Site.

Aggregate liability cap. Where permitted by law, our aggregate liability for direct damages arising from these Terms will be limited to the greater of (a) the total fees paid by you to Pet Union in the 12 months preceding the claim, or (b) a nominal amount (e.g., R1,000). This cap does not apply to liability that cannot be limited by law.

Exceptions. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot be excluded under applicable law.

15. INDEMNIFICATION

You agree to indemnify, defend and hold harmless Pet Union, its officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your breach of these Terms; (b) your contributions; (c) your use of the Site; or (d) your violation of applicable law.

16. USER DATA

Data handling. We collect and process personal information as described in our Privacy Policy. By using the Site you consent to our collection and use of your information in accordance with that Policy.

Backups and retention. We may retain user data as necessary for business operations, legal compliance, fraud prevention and dispute resolution. See the Privacy Policy for retention periods and rights.

17. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Electronic communications. By using the Site you consent to receive electronic communications from us. Notices sent by email or posted on the Site satisfy any legal requirement for written notice.

Electronic transactions and signatures. You agree that electronic records and signatures have the same force and effect as paper records and handwritten signatures to the extent permitted by law.

18. MISCELLANEOUS

Entire agreement. These Terms, together with the Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and Pet Union regarding the Site.

Severability. If any provision is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. Pet Union may assign these Terms in connection with a merger, acquisition or sale of assets.

No waiver. Failure to enforce any right is not a waiver of that right.

Third‑party beneficiaries. Except as expressly provided, these Terms do not create rights for third parties.
